K-1 Visa vs Marriage Green Card

K-1 Fiancé Visa vs. Marriage Green Card — Choosing the Right Path

One of the most common questions we receive is: should we get married abroad first and apply for a marriage green card, or should we use the K-1 fiancé visa? The answer depends on your specific circumstances, timeline, and priorities.

K-1 Fiancé Visa

Advantages:

  • Your fiancé enters the U.S. faster — before the marriage
  • You can get married in the United States
  • Well-established process with clear requirements

Disadvantages:

  • Requires a second filing (I-485) after marriage, adding cost and time
  • 90-day marriage deadline creates pressure
  • Fiancé cannot work or travel freely until green card is approved
  • Only U.S. citizens can file — not permanent residents

Marriage Green Card (CR1/IR1)

Advantages:

  • Your spouse arrives as a permanent resident — no second step
  • Both citizens and permanent residents can sponsor a spouse
  • No 90-day marriage deadline once admitted

Disadvantages:

  • Takes longer before your spouse enters the U.S.
  • You must be legally married before filing
