I-601 Waiver of Inadmissibility

FORMS: Form I-601

Overview

Form I-601 is the standard inadmissibility waiver for individuals abroad seeking immigrant or nonimmigrant visas, or those in the U.S. applying for adjustment of status, who are inadmissible for various grounds. It addresses unlawful presence, fraud/misrepresentation, certain criminal convictions, and health-related inadmissibility — typically requiring proof of extreme hardship to qualifying U.S. citizen or LPR family members.

Eligibility Requirements

Inadmissible under specific grounds eligible for I-601 (3/10-year bars, certain crimes, fraud, health); qualifying U.S. citizen or LPR family member (spouse, parent, child) who would suffer extreme hardship if waiver denied; demonstrate extreme hardship; and merit favorable discretion.

Application Process

Most commonly filed during consular processing or after I-130/I-140 approval. Comprehensive extreme hardship documentation required across multiple hardship factors (financial, medical, emotional, country conditions, family separation impact).

Required Documentation

Required: extensive extreme hardship documentation (medical records, financial impact analysis, psychological evaluations, country conditions reports, expert opinions); supporting affidavits; family relationship evidence; and detailed personal narrative. Hardship must be 'extreme' — beyond ordinary consequences of separation.

Government Filing Fees

I-601 filing fee; supporting evidence costs (psychological evaluations, country experts).

Processing Timeline

I-601 processing 12–36 months currently.
