FORMS: Form I-140, Form I-485 (or DS-260)
The EB-1C provides green cards to multinational executives and managers transferred to the U.S. by qualifying multinational organizations. It is the immigrant counterpart to L-1A and is heavily used by executives and managers already in the U.S. on L-1A status. Like other EB-1 categories, it bypasses PERM Labor Certification.
Beneficiary must have been employed in executive or managerial capacity by qualifying foreign affiliate, parent, subsidiary, or branch for at least 1 year of the 3 years preceding U.S. employment (or in the 3 years preceding the petition if already in U.S. on L-1); the petitioning U.S. employer must have been doing business for at least 1 year; qualifying corporate relationship between U.S. and foreign entity; the U.S. role must be managerial or executive.
Employer files Form I-140 demonstrating: corporate relationship; beneficiary's qualifying foreign role; U.S. role's managerial/executive nature; and U.S. entity's operations. Concurrent I-485 if priority date current. EB-1C does not require labor certification.
Required: corporate relationship documentation (ownership, control); detailed organizational charts (foreign and U.S.); description of beneficiary's foreign role with subordinates; description of U.S. role with executive/managerial duties; financial statements showing both entities doing business; and beneficiary's credentials.
