Health-Related Waiver

FORMS: Form I-601

Overview

Certain health conditions trigger inadmissibility under INA 212(a)(1), including communicable diseases of public health significance (currently, active TB), absence of required vaccinations, mental disorders with harmful behavior, and drug abuse/addiction. Most health-related inadmissibility may be waived under I-601 with appropriate medical evidence and treatment plans.

Eligibility Requirements

Subject to health-related inadmissibility; medical treatability with treatment plan; family ties (typically required); and meeting waiver standards.

Application Process

Medical examination by Civil Surgeon; identification of inadmissibility; supplemental medical documentation; and I-601 filing with treatment compliance evidence.

Required Documentation

Civil Surgeon medical exam report; specialist medical evaluations; treatment plan; sponsor attestation regarding medical care; and family hardship if applicable.
