L-1B Specialized Knowledge Visa

Overview

The L-1B visa allows multinational companies to transfer employees with specialized knowledge of the company's products, services, research, equipment, techniques, or management to U.S. operations. Specialized knowledge is defined as knowledge that is uncommon, distinct from general industry knowledge, and noteworthy. The L-1B is widely used by IT consulting firms, engineering companies, and product specialists.

Eligibility Requirements

Beneficiary must have worked for the qualifying foreign entity for at least one continuous year within the past three years; possess specialized knowledge of company processes/products/procedures; the U.S. role must require that specialized knowledge; and qualifying corporate relationship must exist.

Application Process

Filing process mirrors L-1A but requires more rigorous specialized knowledge documentation. RFEs are extremely common — USCIS heavily scrutinizes whether knowledge is truly specialized vs. generally available in the field. Detailed comparisons with U.S. workforce capabilities are typically necessary.

Required Documentation

Required: corporate relationship documentation; beneficiary's specialized knowledge with specific examples; training records and certifications; prior projects demonstrating expertise; explanation of why such knowledge cannot readily be obtained from U.S. workforce; client/project assignment evidence; and detailed U.S. job duties.

Government Filing Fees

I-129 base fee; Fraud Prevention Fee $500; Asylum Program Fee; Premium Processing optional.


Processing Timeline

Initial validity 1–3 years; Extensions to maximum 5 years (vs. 7 years for L-1A); Standard processing 2–6 months; Premium processing 15 days.
