VAWA Self-Petition

Overview

The Violence Against Women Act (VAWA) allows abused spouses, children, and parents of U.S. citizens or LPRs to self-petition for green cards without the abuser's knowledge or participation. VAWA protects men, women, and same-sex partners. The petition is confidential — the abuser is never notified.

Eligibility Requirements

Spouses: married (or formerly married) to abusive U.S. citizen or LPR; battery or extreme cruelty during marriage; resided with abuser; bona fide marriage. Children: abused by U.S. citizen or LPR parent. Parents: abused by U.S. citizen son or daughter age 21+.

Application Process

Self-petitioner files Form I-360 with comprehensive evidence of: qualifying relationship; abuser's status; battery or extreme cruelty; residence with abuser; good moral character; and (for spouses) good faith marriage. USCIS keeps filings strictly confidential.

Required Documentation

Required: police reports, medical records, photos of injuries; affidavits from witnesses, counselors, social workers; protective orders; abuser's immigration status documentation (often obtained through alternative sources); and personal declaration detailing abuse.

Government Filing Fees

Form I-360 has no filing fee for VAWA petitioners; Biometrics fee may apply.


Processing Timeline

I-360 currently 18–36 months; once approved, beneficiary may file I-485 (some categories may have priority date issues).
