EB-1B Outstanding Researcher / Professor Green Card

FORMS: Form I-140, Form I-485 (or DS-260)

Overview

The EB-1B is for outstanding researchers and professors with international recognition in their academic field. Unlike EB-1A, the EB-1B requires a permanent job offer from a U.S. employer (university, research institution, or qualifying private employer with established research department). It bypasses PERM and offers current priority dates for most countries.

Eligibility Requirements

Applicants must: be internationally recognized as outstanding in their academic field; have at least 3 years of teaching or research experience in the field; have a permanent job offer from a qualifying U.S. employer for tenure/tenure-track or comparable research position. Demonstrate international recognition through at least 2 of 6 criteria: major prizes/awards for outstanding achievement; membership in associations requiring outstanding achievement; published material about applicant; participation as judge of others' work; original scientific/scholarly contributions; authorship of scholarly books/articles in journals with international circulation.

Application Process

Employer files Form I-140 with detailed evidence of beneficiary's international recognition. The job offer must be permanent (tenure, tenure-track, or indefinite-duration research). Concurrent I-485 if priority date current.

Required Documentation

Required: permanent job offer letter from qualifying employer; proof of 3+ years teaching/research experience; evidence under at least 2 regulatory criteria; expert recommendation letters; citation analysis; publication record; and academic/research credentials.

Government Filing Fees

I-140 fee; I-485 fee; Biometrics; Asylum Program Fee; Premium Processing optional.


Processing Timeline

I-140 standard 6–12 months; Premium Processing 15 days; I-485 8–14 months.
