Refugee Status

FORMS: Form I-590 (filed abroad)

Overview

Refugee status is granted to individuals overseas who meet the asylum definition but apply from outside the U.S. Refugees are processed through U.S. embassies, designated processing posts, or UN High Commissioner for Refugees referrals. Refugee admission numbers are set annually by Presidential determination. Once admitted, refugees may apply for green cards after one year.

Eligibility Requirements

Asylum definition (persecution on protected grounds); outside home country; outside U.S.; not firmly resettled; admissibility to U.S.; processing through designated channels.

Application Process

Identification through UNHCR or U.S. embassy; security and medical screening; refugee interview; admission to U.S.; one-year-later green card via I-485.

Required Documentation

Same persecution evidence as asylum; identification through proper channels.

Government Filing Fees

Generally no fee.


Processing Timeline

Multi-year process; varies enormously by country and program.
