L-1A Executive / Manager Visa

Overview

The L-1A visa permits multinational companies to transfer executives and managers from foreign offices to U.S. offices (existing or new). It is one of the most strategically valuable nonimmigrant categories because L-1A holders can self-petition for EB-1C immigrant status — bypassing the PERM Labor Certification process entirely. L-1A is widely used by Fortune 500 companies, growing multinational firms, and companies establishing first U.S. operations.

Eligibility Requirements

Beneficiary must have worked for the foreign affiliate, parent, subsidiary, or branch in an executive or managerial capacity for at least one continuous year within the three years preceding the U.S. transfer; U.S. and foreign entities must have a qualifying corporate relationship; the U.S. position must also be executive or managerial; and the qualifying organization must be doing business in both countries.

Application Process

Step 1: Establish qualifying corporate relationship between U.S. and foreign entity. Step 2: Document beneficiary's qualifying executive/managerial role abroad for one year minimum. Step 3: File Form I-129 with comprehensive supporting evidence. Step 4: For new offices, USCIS scrutinizes business plans and physical premises closely; initial approval limited to one year.

Required Documentation

Required documentation: corporate relationship evidence (stock certificates, articles, financial statements showing ownership); detailed organizational charts of both entities; description of beneficiary's foreign role with subordinate structure; description of U.S. role demonstrating executive/managerial duties; financial documents showing both entities are doing business; for new offices, business plan, lease, hiring plan; and beneficiary's resume and credentials.

Government Filing Fees

I-129 base fee; Fraud Prevention Fee $500; Asylum Program Fee; Premium Processing optional.


Processing Timeline

Standard processing 2–6 months; Premium processing 15 days; Initial validity: 1 year (new office) or 3 years (existing office); Extensions in 2-year increments to maximum 7 years.
