Schedule A is a DOL pre-certified list of occupations where insufficient U.S. workers exist — currently limited to professional nurses (RNs) and physical therapists. Schedule A occupations bypass PERM Labor Certification, allowing direct I-140 filing while maintaining EB-2 (or EB-3) classification. This dramatically accelerates green card processing for healthcare professionals.
Beneficiary must qualify as professional nurse (passed CGFNS or NCLEX, U.S. state RN license or eligibility) or physical therapist (state PT license or eligibility). Position must meet Schedule A requirements; employer must conduct posted notice; and applicant must qualify for EB-2 or EB-3 preference.
Employer skips PERM application but must conduct posted notice (10 business days at worksite) and prevailing wage determination. Employer files Form I-140 directly with notice and wage documentation. Concurrent I-485 if priority date current.
