Convention Against Torture (CAT)

Overview

CAT (Convention Against Torture) protects individuals from removal to countries where they would more likely than not be tortured. CAT requires no protected-ground nexus (unlike asylum/withholding) and is unavailable as affirmative protection — only as a defensive claim in removal proceedings. CAT relief comes in two forms: withholding of removal under CAT (similar to withholding) or deferral of removal (limited form).

Eligibility Requirements

More likely than not (>50%) probability of torture if returned; torture by or with consent/acquiescence of public official; intentional infliction of severe pain or suffering; lawful sanctions excluded.

Application Process

Filed defensively in immigration court using Form I-589.

Required Documentation

Country conditions evidence of torture; specific risk to applicant; potentially expert testimony on country conditions and torture practices.

Government Filing Fees

No fee.
