H-1B1 Visa (Chile / Singapore)

Overview

The H-1B1 is a specialty occupation visa created under the U.S.-Chile and U.S.-Singapore Free Trade Agreements. It is reserved exclusively for nationals of Chile (1,400 visas annually) and Singapore (5,400 visas annually). Unused H-1B1 numbers roll over to the next fiscal year's regular H-1B cap. Unlike the H-1B, the H-1B1 has its own separate quota that has historically not been exhausted, making it an attractive alternative for qualifying nationals.

Eligibility Requirements

Applicants must be citizens of Chile or Singapore (not just residents); the position must qualify as a specialty occupation requiring at least a bachelor's degree in a specific field; the beneficiary must hold the required degree or equivalent; and the employer must obtain a certified LCA. The H-1B1 requires intent to depart the U.S. at the end of authorized stay (no dual intent).

Application Process

Applicants outside the U.S. typically apply directly at a U.S. consulate using Form DS-160 with a certified LCA — no I-129 petition required for initial visa. Those already in the U.S. may file Form I-129 to change or extend status. Initial admission is granted for one year (renewable indefinitely in one-year increments).

Required documentation: proof of Chilean or Singaporean citizenship; certified LCA; bachelor's degree in the specific field; employer offer letter detailing duties and salary; evidence of specialty occupation nature; and proof of nonimmigrant intent (return ties to home country).

Government Filing Fees

Standard I-129 filing fees apply when filed in the U.S. Consular fees apply for visa issuance abroad. The H-1B1 is NOT subject to the $100,000 H-1B Proclamation Fee, the H-1B registration fee, the ACWIA training fee, or the fraud prevention fee.


Processing Timeline

Visa numbers typically remain available year-round. Consular processing varies by post (typically 2–8 weeks). I-129 processing for change of status: 2–4 months standard, 15 days with premium processing.
