F1 Unmarried Adult Child of Citizen

FORMS: Form I-130, Form DS-260 (or I-485)

Overview

F1 is the family-based first preference for unmarried adult sons and daughters (21+) of U.S. citizens. Unlike Immediate Relative categories, F1 is subject to annual numerical caps and per- country limitations, resulting in priority date wait times — typically 7–15 years depending on country of birth (significantly longer for Mexico and Philippines).

Eligibility Requirements

U.S. citizen parent petitioner; beneficiary unmarried (essential — marriage during wait converts to F3 category and resets priority date in some scenarios); beneficiary 21 or older; valid parent- child relationship.

Application Process

U.S. citizen parent files Form I-130. Petition then waits in line per Visa Bulletin priority date. When current, beneficiary files I-485 (if in U.S.) or DS-260 (if abroad).

Required Documentation

Required: parent-child relationship evidence; U.S. citizen status of petitioner; beneficiary unmarried evidence (continuing through adjudication); and standard supporting documentation.

Government Filing Fees

I-130 fee; I-485 or visa fees later.

Processing Timeline

I-130 adjudication 6–14 months; Priority date wait 7–15+ years; Adjudication of green card 8–14 months once current.
