FORMS: Form I-751
Form I-751 removes conditions from a 2-year conditional green card obtained through marriage to a U.S. citizen (CR-1 status). Filing must occur within 90 days before the 2-year anniversary of conditional residency. Joint filing is the norm; waivers are available for divorce, abuse, or extreme hardship situations.
Joint filing: marriage still valid; both spouses sign petition; provide evidence of bona fide marriage during the 2-year period. Waiver filings: marriage entered in good faith but ended (divorce/annulment); extreme hardship; or battery/extreme cruelty.
File Form I-751 within 90-day window before conditional green card expiration. Joint filing with spouse, or self-petition with waiver. USCIS interview may be scheduled. Upon approval, 10-year green card issued.
Joint filing: bona fide marriage evidence covering 2-year period (taxes, leases, accounts, photos, communications, affidavits). Waiver: divorce decree, hardship documentation, or abuse evidence.
