IR-5 Parent of U.S. Citizen

Overview

IR-5 provides green cards to parents of U.S. citizens age 21 or older. Like other Immediate Relative categories, IR-5 has no numerical cap and current priority dates. This is a common pathway for adult U.S. citizens to bring elderly parents to the U.S. permanently.

Eligibility Requirements

U.S. citizen petitioner age 21+; biological, step (specific conditions), or adoptive parent relationship; valid parent-child relationship documented.

Application Process

U.S. citizen child files Form I-130 for each parent (separate I-130 for each parent). AOS if parent in U.S. and entered legally; consular processing if parent abroad.

Required Documentation

Required: petitioner's birth certificate showing relationship; petitioner's U.S. passport or naturalization certificate; parent's birth certificate; marriage certificates (if step-parent); affidavit of support; and medical examination.

Government Filing Fees

I-130 fee per parent; I-485 fees; visa fees.


Processing Timeline

I-130 6–14 months; AOS/consular processing 8–14 months.
