FORMS: Form I-129F, Form DS-160 (consular)
The K-1 visa allows U.S. citizens to bring their foreign fiancé(e) to the U.S. specifically to marry within 90 days of arrival. After the marriage, the K-1 spouse adjusts status to lawful permanent resident (CR-1 conditional). K-1 is appropriate when the U.S. citizen and foreign fiancé(e) want to marry in the U.S.
U.S. citizen petitioner; couple legally able to marry; couple has met in person within 2 years before filing (cultural/religious exemptions possible); both unmarried at filing and free to marry; bona fide intention to marry; and intent to marry within 90 days of fiancé(e)'s entry.
Step 1: U.S. citizen files Form I-129F. Step 2: USCIS approves and forwards to NVC, then to U.S. consulate. Step 3: Fiancé(e) interviews at consulate, receives K-1 visa. Step 4: Fiancé(e) enters U.S., marries within 90 days, then files I-485 for green card.
Evidence of meeting in person within 2 years; statement of intent to marry; proof of bona fide relationship; petitioner's U.S. citizenship; both parties' eligibility to marry (divorce decrees if prior marriages); and beneficiary admissibility.
I-129F fee; visa application fee; medical examination; later I-485 fees.
I-129F: 8–18 months; Consular processing: 4–8 months; Total before entry: 12–24 months; Marriage within 90 days; I-485 processing: 8–14 months.
We represent K-1 couples through the complete process — petition through marriage and adjustment of status. Specializations include cases with unique relationship circumstances, prior marriages, and complex bona fide documentation.
